Our expertise as payments lawyers means we are ideally suited to help you recover merchant reserves from your payment processors and partners when they are improperly withheld.
Merchant agreements generally impose specific limitations on your payment processor’s ability to assess and withhold reserves. For example, most agreements require a return of reserves at the expiration of the six or nine-month mark. By that time, the risk of continuing chargebacks and returns is almost non-existent. So, unless your business is the subject of a regulatory investigation or enforcement action – or the processor has a reasonable belief that your processing activity is likely to produce Card Brand fines – most processors will have a hard time justifying the continued withholding of your merchant reserves under most agreements.
